Terms of Service
Effective date: 20 April 2026
These Terms of Service (“Terms”) govern your access to and use of the Tonight mobile application and related services (collectively, the “App” or “Service”) provided by Vybe sp. z o.o. (“Vybe”, “we”, “us”, or “our”).
By creating an account, accessing, or using Tonight, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. About Tonight
Tonight is a social discovery and meetup app. It allows users to create a profile, browse other signed-in users nearby, match with other users, enter meetup zones, and, if two users mutually agree to a meetup, share live location for the duration of that meetup so they can find each other.
Tonight is a platform that facilitates user discovery and meetup coordination. Vybe does not organize, supervise, control, or guarantee any in-person interaction between users.
3. Eligibility
You may use Tonight only if:
- you are at least 16 years old; and
- you are old enough under the laws of your country, state, or region to use this type of service.
By using the Service, you represent and warrant that you meet these requirements.
We may require age or identity-related checks, including selfie verification, and may suspend or remove accounts that do not satisfy our eligibility requirements.
4. Account Registration and Authentication
To use Tonight, you must create an account using:
- Sign in with Apple on iOS; or
- Sign in with Google on Android.
You agree to:
- provide accurate, current, and complete information;
- keep your account information up to date;
- maintain the security of your account;
- use only your own account; and
- accept responsibility for activities that occur under your account.
You may not transfer, sell, rent, share, or give your account to another person.
5. Mandatory Verification
Selfie verification is mandatory to use Tonight.
You agree to complete verification procedures honestly and using your own likeness. You may not:
- impersonate another person;
- use edited, misleading, or AI-generated identity material for verification;
- attempt to bypass verification controls; or
- create new accounts to evade previous restrictions or bans.
We may deny, suspend, or terminate access if verification fails or if we reasonably suspect fraud, impersonation, or abuse.
6. Profile Visibility and User Content
Your profile may be shown to other signed-in users nearby. Your profile may include your photos, first name or display name, age, bio, interests, and other profile information you choose to provide.
You are solely responsible for the content you upload, submit, display, or otherwise make available through the Service (“User Content”).
You represent and warrant that:
- you own or have the necessary rights to your User Content;
- your User Content does not violate any law or any third party’s rights, including privacy, publicity, intellectual property, or contractual rights; and
- your User Content complies with these Terms and our platform rules.
7. Prohibited Conduct
You may not use Tonight to do, promote, or facilitate any of the following:
- impersonating any person or entity
- using fake identities
- using someone else’s photos or profile details
- harassment, threats, bullying, stalking, intimidation, or abuse
- hate speech or discriminatory conduct
- nudity, sexually explicit content, or sexual exploitation
- advertising, spam, scams, or unauthorized commercial solicitation
- promotion of illegal goods, illegal drugs, weapons, or unlawful activity
- escorting, prostitution, or sexual services solicitation
- publishing another person’s private or personal information without permission
- sharing social media handles, phone numbers, or off-platform contact details in profile bios where prohibited by our rules
- creating multiple accounts for deceptive purposes
- circumventing bans, blocks, moderation systems, or safety measures
- using bots, scripts, scraping tools, automation, reverse engineering, or unauthorized third-party tools
- interfering with the operation, security, or integrity of the Service
- using the Service in any way that violates applicable law or regulation
We may determine, in our sole discretion, whether conduct or content violates these Terms or creates risk for users, third parties, or the Service.
8. Meetup Zones and In-Person Meetings
Meetup zones are optional Service features that may allow users in a particular area to receive meetup suggestions and coordinate in-person meetings.
When you enter a meetup zone:
- you may participate in matching and meetup suggestions;
- you may opt out of matching after entering the zone; and
- if you and another user both accept a meetup, a live location-sharing session may begin for that meetup.
You understand and agree that:
- Vybe does not screen, endorse, or guarantee any user’s behavior, identity, intentions, or truthfulness;
- Vybe does not supervise in-person meetings;
- all in-person interactions are at your own risk;
- you are solely responsible for your decisions before, during, and after a meetup; and
- you should use independent judgment and appropriate caution when deciding whether to meet another person.
9. Live Location Sharing
If two users mutually accept a meetup, Tonight may enable live location sharing between those two users for the duration of the meetup.
By accepting a meetup, you instruct us to share your real-time location with the other meetup participant until the meetup ends or is cancelled.
You acknowledge and agree that:
- location data may be approximate, delayed, interrupted, or inaccurate;
- the Service does not guarantee another user’s exact location, continued presence, identity, or intentions;
- location-sharing functionality may fail due to device, network, mapping, battery, permission, operating-system, or other technical issues; and
- either participant may cancel a meetup at any time, which stops location sharing for that meetup.
10. Safety Tools
Tonight may offer safety features such as reporting, blocking, verification, automated detection systems, and manual moderation. These tools are intended to reduce risk, not eliminate it.
Vybe does not guarantee that:
- all harmful conduct will be detected;
- all reports will result in action;
- all profiles are genuine or accurate; or
- any safety feature will prevent all harm, misconduct, or unauthorized behavior.
If you believe you are in danger or are facing an emergency, do not rely solely on the App. Contact local emergency services.
11. License to Use the Service
Subject to these Terms, Vybe grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for its intended consumer purpose.
You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, transmit, sell, license, or exploit any part of the Service except as expressly permitted by us or by applicable law.
12. Your Rights in User Content; License to Vybe
You retain ownership of your User Content.
However, by uploading, submitting, or making User Content available through Tonight, you grant Vybe a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, copy, reproduce, process, adapt, display, publish, transmit, moderate, review, and otherwise use that User Content as necessary to:
- operate and provide the Service;
- display your profile to other users;
- improve safety, moderation, and fraud prevention;
- detect abuse and enforce these Terms; and
- comply with legal obligations.
This license ends within a commercially reasonable time after your User Content is deleted from the Service, except to the extent retention is reasonably necessary for backups, legal compliance, fraud prevention, enforcement, dispute resolution, or safety purposes.
13. Moderation and Enforcement
We reserve the right, at any time and in our sole discretion, to:
- review profiles, photos, verification materials, and other content;
- remove or restrict any User Content;
- limit visibility of a profile;
- suspend or terminate an account;
- block devices, credentials, payment methods if later introduced, or other identifiers;
- investigate suspected violations, fraud, abuse, or illegal activity; and
- preserve or use relevant information to prevent repeated abuse or ban evasion.
We may take action with or without prior notice, especially in serious or repeat cases.
14. Inactive, Stale, and Unfinished Accounts
We may deactivate, remove, reclaim, or delete accounts that are stale, inactive, incomplete, unverified, or unfinished after a period of inactivity or non-completion, in order to maintain service quality, security, and operational integrity.
Where appropriate, we may attempt to notify you before taking such action, but we are not required to do so.
15. Account Deletion and Termination by You
You may stop using the Service at any time.
You may delete your account:
- within the App settings; or
- through the external deletion page at https://tonight.zone/delete-account
Deleting your account will terminate your access to the Service, subject to any limited retention described in our Privacy Policy for legal, security, fraud-prevention, and safety purposes.
16. Future Paid Features
The Service is currently offered without paid features. However, Vybe may introduce paid services, subscriptions, premium features, deposits, or other paid functionality in the future.
If we do, additional terms, pricing, billing conditions, cancellation rules, and refund rules may apply and will be presented to you at that time.
17. Intellectual Property
The Service, including its software, design, trademarks, logos, branding, interfaces, text, graphics, and other content provided by Vybe, is owned by or licensed to Vybe and is protected by applicable intellectual property and other laws.
Except for the limited license expressly granted in these Terms, no rights are granted to you.
“Tonight,” “Vybe,” and related names, logos, product names, and branding may not be used without our prior written permission, except as allowed by law.
18. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, disclose, and retain personal data.
19. Third-Party Services and Platforms
The Service may rely on or interoperate with third-party services, platforms, SDKs, infrastructure providers, identity providers, mapping providers, or device operating systems.
We are not responsible for the availability, accuracy, security, or practices of third-party services except as required by applicable law.
Your use of Sign in with Apple, Sign in with Google, app stores, mobile operating systems, and other third-party services may also be subject to those third parties’ own terms and policies.
20. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.
Vybe disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, security, accuracy, and uninterrupted operation.
Without limiting the above, we do not warrant that:
- the Service will be uninterrupted, error-free, secure, or always available;
- matching, meetup suggestions, or location features will be accurate or effective;
- any user is who they claim to be;
- any meetup will occur as expected;
- the Service will prevent harm, misconduct, fraud, harassment, or unwanted interactions.
Nothing in these Terms excludes rights that cannot be excluded under applicable consumer law.
21. Limitation of Liability
To the maximum extent permitted by applicable law, Vybe and its directors, officers, employees, shareholders, contractors, affiliates, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, data, or opportunity, arising out of or related to your use of or inability to use the Service.
To the fullest extent permitted by law, Vybe’s liability for claims arising out of or related to the Service is excluded except where liability cannot be excluded under applicable law.
Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.
22. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold harmless Vybe and its directors, officers, employees, affiliates, contractors, and agents from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:
- your User Content;
- your misuse of the Service;
- your violation of these Terms;
- your violation of law; or
- your interaction with another user.
This clause does not apply to the extent a claim results from our own unlawful conduct or gross negligence where such exclusion is prohibited by law.
23. Suspension and Termination by Vybe
We may suspend, restrict, or terminate your access to all or part of the Service at any time, with or without notice, if:
- you violate these Terms;
- we reasonably suspect fraud, abuse, or unlawful activity;
- you create risk or possible legal exposure for us or others;
- your account is inactive, incomplete, or unverifiable;
- we are required to do so by law; or
- we discontinue the Service or part of it.
Sections that by their nature should survive termination will survive, including provisions on ownership, licenses, disclaimers, limitation of liability, indemnity, disputes, and enforcement.
24. Changes to the Service
We may modify, suspend, or discontinue any part of the Service at any time, temporarily or permanently, including features, functionality, design, availability, or geographic coverage.
We are not liable for any modification, suspension, or discontinuation except as required by applicable law.
25. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we may notify you through the App, by email, or by other reasonable means. Your continued use of the Service after the updated Terms become effective means you accept the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service and delete your account.
26. Governing Law and Jurisdiction
These Terms are governed by the laws of Poland, excluding its conflict-of-laws rules.
The courts of Warsaw, Poland shall have jurisdiction over disputes arising from or relating to these Terms or the Service.
If you are a consumer and mandatory law in your place of residence gives you the benefit of protections that cannot be excluded by contract, nothing in these Terms deprives you of those protections.
27. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.
28. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms expressly presented to you within the Service, form the entire agreement between you and Vybe regarding the Service and supersede prior discussions or agreements relating to the same subject matter.
